The Costa del Sol — covering towns and cities from Málaga and Marbella to Nerja and Torremolinos — falls under the Junta de Andalucía's tourist accommodation framework. Holiday rental owners here must register as a Vivienda con Fines Turísticos (VITUR) with the Registro de Turismo de Andalucía, in addition to complying with national obligations including SES Hospedajes and the NRA.
Since Royal Decree 933/2021 came into force in December 2024, every holiday rental operator on the Costa del Sol must submit guest ID data to SES Hospedajes within 24 hours of arrival. This applies to all property types and all booking channels — whether through Airbnb, Booking.com, or a direct booking from your website. The platform does not fulfil this obligation on your behalf.

Legal requirements for Costa del Sol rental owners
VITUR Registration
All holiday rentals in Andalusia must register as Viviendas con Fines Turísticos with the Junta de Andalucía. The property must meet minimum habitability standards. The VITUR number must appear on all listing platforms.
NRA Registration
From January 2025, a Número de Registro de Alquiler must also appear on all listings across Spain. This is a national requirement and is separate from your regional VITUR number.
SES Hospedajes Guest Registration
Under Royal Decree 933/2021, guest ID data must be submitted to SES Hospedajes within 24 hours of arrival. Fines for non-compliance range from €600 to €30,000.
Income Tax / IVA
Andalusia is subject to mainland Spain's tax rules. Tourist rental income is subject to IRPF. Where hotel-like services (meals, daily cleaning) are provided, IVA at 10% may apply.
