Compliance for Marbella holiday rentals
Marbella is one of Spain's highest-value holiday rental markets, attracting premium guests to the Golden Mile, Puerto Banús, Nueva Andalucía, and Estepona. The rental market is well-established, and so is the regulatory framework. Under Andalusia's tourist accommodation legislation, all properties must be registered as Viviendas con Fines Turísticos (VITUR) with the Junta de Andalucía before advertising. The VITUR number must appear on all listing platforms.
Since Royal Decree 933/2021 came into force in December 2024, every Marbella rental owner must submit each guest's ID data to SES Hospedajes within 24 hours of arrival. This applies equally to villa owners, apartment hosts, and townhouse rentals — whether managed directly or through a property management company. Marbella's municipal inspectorate has been active in enforcing compliance, particularly in high-density rental areas.
As an Andalusia property, Marbella rentals are subject to mainland Spain's tax system — IRPF on rental income, and IVA at 10% if hotel-like services (daily cleaning, welcome packs, meals) are included in the rental. From January 2025, all properties must also display a national NRA number on listings, in addition to their VITUR registration.
Legal requirements for Marbella rental owners
VITUR Registration
All holiday rentals in Andalusia — including Marbella, Puerto Banús, and the Golden Mile — must be registered as Viviendas con Fines Turísticos with the Junta de Andalucía. The VITUR number must be displayed on all listing platforms. Properties must meet minimum habitability and safety standards.
NRA Registration
From January 2025, a Número de Registro de Alquiler must also appear on all listings. This is a national requirement applied for via Spain's VUDA system and required separately from your VITUR registration.
SES Hospedajes Guest Registration
Under Royal Decree 933/2021, ID data for every guest over 14 must be submitted to SES Hospedajes within 24 hours of arrival. Given Marbella's profile, enforcement inspections are regular.
Income Tax / IVA
Marbella properties are subject to mainland Spanish tax rules. Rental income is subject to IRPF (or IS for companies). IVA at 10% applies if hotel-like services are included in the rental price.

Can a property management company handle SES Hospedajes on my behalf?
